VitalGuard – Patient Privacy Policy

Your health is personal. So is your data. At VitalGuard LLC (“VitalGuard,” “we,” “us,” or “our”), we provide direct-to-consumer remote patient monitoring (RPM) and chronic care management (CCM) services designed to support you and your care team. This Patient Privacy Policy explains how we collect, use, share, and protect information about you when you use our patient-facing mobile/desktop application and websites that link to this policy (together, the “Platform”) and our related services (the “Services”).

HIPAA note: When we handle information that identifies you and relates to your health or care, it may be Protected Health Information (PHI). PHI is governed by HIPAA and our Notice of Privacy Practices, which controls if there’s any conflict with this policy.

1) Who this policy is for & what it covers

This policy is for patients who use VitalGuard. It explains our practices for “personal data,” which includes information that can reasonably identify you. Some of this personal data will be health data or PHI.

This policy does not cover non-VitalGuard websites or services we do not control, even if we link to them. Please review those sites’ privacy statements before using them.

By using the Platform or Services, you agree to this policy and our terms. If you do not agree, please stop using the Platform and Services.

2) The information we collect

We collect only what we need to provide, secure, and improve your experience.

a) Profile information (you provide)

Examples: name, contact details, year of birth, gender, height/weight, and any other details you choose to share to set up or manage your account.

b) Health & care information (you and your care team provide)

Examples: medical history, symptoms, diagnoses, medications, care plans, readings from RPM devices (e.g., blood pressure, weight, SpO₂, glucose), images you upload, and messages or notes exchanged through the Platform with your authorized care team.

c) Support & communication information

If you email us, we receive your message content, email address, and any related metadata. We use this to troubleshoot issues, respond to requests, improve functionality, and maintain safety.

d) Device & usage information (collected automatically)

Like most online services, we use cookies, pixels, SDKs, and logs. Examples: IP address, device IDs, browser/OS type, screen settings, pages viewed, time stamps, and general location derived from IP. We use this to run the site, measure performance, detect and prevent abuse, and improve your experience.

3) How we use your information

We process personal data for the following purposes (and, where required, on bases such as consent, performance of a contract, legitimate interests, and/or legal obligations):

  • Care delivery: provide RPM/CCM services, display your data to you, and enable your authorized clinicians to view readings and trends.
  • Account & operations: create and manage your account, authenticate access, and maintain accurate records.
  • Support & safety: respond to questions, fix bugs, detect/prevent misuse, and protect the Platform and its users.
  • Service improvement: analyze usage to develop new features, enhance reliability, and improve the patient experience.
  • Legal & compliance: follow laws, respond to lawful requests, and enforce our terms.
  • Communications: send administrative notices (e.g., policy updates, service alerts). If we send educational or promotional emails, you can opt out (see Your Choices).

We may create aggregated or de-identified data that does not identify you and use or share it for lawful purposes.

4) How we share information

We do not sell your personal information. We may share as follows:

  • Your authorized clinicians/care team: To deliver RPM/CCM, we share relevant data with the providers you authorize. You may change provider access by emailing hello@myvitalguard.com.
  • Service providers (processors): Trusted vendors that host data, provide security, analytics, email delivery, device connectivity, and customer support—bound by confidentiality and use-limitations.
  • At your direction: When you ask us to share data with a third party.
  • Legal, safety, and compliance: To comply with law or protect rights, safety, and the integrity of our Services.
  • Business transfers: If we undergo a reorganization, merger, or similar transaction, your data may transfer as part of that process.

Where data is transferred outside your jurisdiction, we apply safeguards as required by applicable law. Data is generally processed in the United States.

5) Cookies & similar technologies (and your choices)

Cookies and similar tools help the Platform function, remember preferences, and measure performance.

  • What we use: essential (security, login), functional (preferences), and analytics (usage insights).
  • Your choices: most browsers let you block or delete cookies. If you do, some features may not work as intended.
  • Do Not Track: we currently do not respond to DNT signals because standards are not yet consistent.

If you prefer not to be included in analytics that rely on cookies or similar tools, you can adjust your browser settings; you can also email hello@myvitalguard.com for general guidance.

6) Data retention

We keep personal data only as long as necessary to provide the Services, meet legal/operational needs, and maintain records. When no longer needed, we aim to delete, de-identify, or aggregate it, subject to technical limitations (e.g., backups). We may continue to use de-identified data consistent with applicable law.

7) Security

We use reasonable administrative, technical, and physical safeguards—such as access controls, encryption in transit (HTTPS), logging, and backups—to help protect your information. No method is perfectly secure, and we cannot guarantee absolute security. If we determine a security incident affected your personal information, we’ll investigate and notify you as required by law.

8) Children’s privacy

The Platform and Services are not directed to individuals under 18, and we do not knowingly collect personal information from children under 18. If you believe a child has provided information to us, please email hello@myvitalguard.com so we can delete it.

9) Your choices & rights

Depending on your location and applicable law, you may have rights such as:

  • Access & portability (receive a copy of certain data)
  • Correction (fix inaccurate data)
  • Deletion (request we delete certain data)
  • Restriction/objection (limit or object to certain processing)
  • Consent withdrawal (where processing relies on consent)
  • Marketing preferences (opt out of non-essential emails)

To exercise any of these rights—or to manage provider access—email hello@myvitalguard.com. We may need to verify your identity before acting on your request and may deny requests that conflict with legal obligations or compromise the Services’ security or integrity.

Email preferences: If you receive educational or promotional messages from us, you can opt out by emailing hello@myvitalguard.com with “Unsubscribe” in the subject line. We may still send important administrative/service messages.

10) Account deletion

If you wish to delete your VitalGuard account, email hello@myvitalguard.com from the email associated with your account and include:

  1. “Account Deletion Request” in the subject line;
  2. Your login email; and
  3. A brief statement confirming you want the account deleted.

Deleting your account will limit access to historical information in the Platform. Due to backups and legal requirements, complete deletion from all systems may not be immediately possible, but we will take reasonable steps to remove active records and restrict any residual backup copies from further processing.

11) State-specific privacy disclosures (U.S.)

Residents of states with consumer privacy laws (e.g., California/CPRA, Colorado, Connecticut, Utah, Virginia) may have additional rights, including rights to know, correct, delete, and opt out of certain cross-context behavioral advertising (“sharing”) or “sales” as defined by law. We do not sell personal information and do not use sensitive personal information collected via the Platform to infer characteristics.

12) Third-party links and services

If our Platform links to third-party sites or tools, your use of those services is governed by their policies, not ours. Please review their privacy practices.

13) Changes to this policy

We may update this policy from time to time. When we do, we’ll change the “Last updated” date above and post the revised policy on the Platform. Your continued use after changes are posted means you accept the updated policy.
